By accessing or using our Website or submitting a booking request (“Services”), you agree to these Terms.
If you do not agree, please do not use our Services.

1. Use of Services
By using our Website, you confirm that you:
- are legally capable of entering into a binding agreement in your jurisdiction, and
- will use the Website only for lawful, legitimate booking-related purposes.
We do not require you to create an account. All necessary information is collected during the booking process.
Your use of the Services is also governed by our Privacy Policy, available on our Website.
2. Description of Services
MontExplore provides a platform where visitors (“Clients”) may view information about a guided outdoor experience (“Tour”) and submit booking requests.
The Tour itself is operated and delivered by an independent licensed provider (“Partner”), such as Explorer or another authorized guiding provider.
Mont Explore:
- presents Tour information,
- coordinates communication between Clients and the Partner,
- facilitates payment processing,
- and assists with logistics.
MontExplore does not guide, operate, insure, or physically execute the Tour.
By completing a booking, you enter into a direct contractual relationship with the Partner providing the Tour.
3. Booking Process
When you submit a booking request:
- We forward your preferred dates and details to the Partner.
- The Partner confirms availability or proposes alternatives.
- Your booking is considered final once you receive written confirmation from MontExplore.
All terms relating to participation in the Tour—including safety requirements, equipment, fitness level, and cancellation rules—are set by the Partner.
MontExplore acts strictly as a facilitator and is not a party to the contract for the performance of the Tour.
4. Payments
Payments are processed securely through certified third-party payment processors.
MontExplore does not store or access full payment details such as:
- full card numbers
- CVC codes
- IBANs
- billing addresses
We may receive non-sensitive payment status information (paid/unpaid, transaction ID).
We may share booking details (but never your payment data) with the Partner strictly for operational purposes.
We may refuse a booking in the event of:
- suspected fraud,
- payment failure,
- technical errors, or
- unavailability of the Tour.
5. Cancellations and Changes
5.1. Cancellations by the Client
The cancellation rules for each Tour are fully determined by the Partner.
You can view the exact cancellation policy on the checkout page before completing your booking.
Refunds, if applicable, are issued solely in accordance with the Partner’s cancellation policy.
5.2. Changes or Cancellations by the Partner
The Partner may modify or cancel the Tour for safety-related reasons, including:
- severe or unstable weather,
- unsafe terrain or environmental conditions,
- participant health or safety concerns,
- operational or logistical issues.
If this occurs, MontExplore will assist you in obtaining:
- an alternative date, or
- a refund, following the Partner’s policy.
5.3. No Guarantee of Specific Outcomes
Outdoor travel involves inherent uncertainty.
The Partner may adjust the route, pace, or activities for safety.
Once the Tour begins, refunds are typically not available for:
- weather-related interruptions,
- early termination for safety,
- your personal decision not to continue,
- lack of fitness or improper equipment.
6. Client Responsibilities
By booking a Tour, you confirm that you:
- understand outdoor activities involve risks,
- are physically capable of participating,
- will follow the Partner’s safety instructions,
- will provide accurate information relevant to safety or logistics,
- will bring required clothing and equipment.
You accept full responsibility for your own physical condition and actions during the Tour.
7. User Conduct
You agree not to:
- misuse the Website or Services,
- interfere with its functionality,
- distribute harmful or illegal content,
- scrape or copy Website content without permission,
- attempt unauthorized access or security breaches.
Violation may result in restricted access or termination.
8. Intellectual Property
All content on the Website, including text, images, design, and branding, is owned by MontExplore or its Partners.
You may not copy, distribute, or commercially use Website content without written permission.
If you submit testimonials, reviews, or photos (“User Content”), you grant MontExplore a non-exclusive, royalty-free license to display and use such content for marketing and Website purposes.
9. Third-Party Links
The Website may contain links to external websites.
MontExplore is not responsible for the content, policies, or actions of such third-party sites.
Use them at your own discretion.
10. Limitation of Liability
To the fullest extent permitted by law, MontExplore is not liable for:
- injuries, accidents, damage, or death occurring during the Tour,
- acts, omissions, errors, or negligence of the Partner,
- inaccuracies or changes in Tour details,
- Website interruptions or technical issues,
- circumstances beyond our control.
MontExplore does not operate the Tour and is not responsible for its execution, safety, or insurance.
This limitation does not override mandatory consumer protections under Croatian or EU law.
11. Indemnification
You agree to indemnify and hold MontExplore harmless from any claims, damages, losses, or expenses arising from:
- your use of the Website or Services,
- your breach of these Terms,
- your participation in the Tour.
12. Privacy and Data Protection
Your use of the Website is governed by our Privacy Policy, which explains:
- what data we collect,
- how we use it,
- how we share it,
- your rights under GDPR.
By using the Services, you agree to the Privacy Policy, available on our Website.
13. Termination of Services
MontExplore may suspend or terminate access to the Website at any time due to:
- misuse,
- legal obligations,
- security concerns,
- discontinuation of Services.
Certain clauses (liability, indemnification, intellectual property) survive termination.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Croatia.
Any dispute shall be resolved before the competent court in Zagreb, unless otherwise required by mandatory consumer law.
15. Miscellaneous
Severability: If any part of these Terms is invalid, the rest remains in force.
No Waiver: Failure to enforce a right does not waive it.
Entire Agreement: These Terms, along with our Privacy Policy, form the full agreement between you and MontExplore.
Assignment: Clients may not assign their rights under these Terms without written consent.
MontExplore may assign these Terms in connection with mergers or business transfers.
